General Terms & Conditions

Disney+ Offerings

This Disney+ Offerings Terms and Conditions (the “Terms”) apply to you and govern your subscription to the Disney+ Offerings which we make available to you through our Digicel + packages (the “Packages”). You should read these Terms carefully before subscribing to Disney+ Offering as well as the Walt Disney Corporation Disney + terms and conditions as provided at (please provide website).

“We” or “us” means SANTA BARBARA UTILITIES N.V. T/A Digicel+ a company incorporated in Curacao, having its registered office at Biesheuvel 24-25, Willemstad Curaçao. References to “Digicel”, “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“You” means the Digicel customer, with a Digicel + subscription, who subscribed to Disney+ Offering (and “your” shall have the same meaning).

These Terms incorporate the Digicel + (Fiber to the Home) Terms and Conditions.

By subscribing to Disney+ Offering, you agree to be bound by these Terms.

 

1.     ABOUT THE DISNEY+ SERVICE

1.1.  Disney+ is a digital streaming service which is controlled and branded by Disney DTC Latam Inc. (U.S.).

 

2.     ABOUT THE OFFERINGS

2.1.  The Disney+ Offering is made available to you as of 25 August 2022 if you have a new or current Digicel + subscription and you also want to subscribe to Disney+. You will have access to the Disney+ service for thirty (30) days. Your subscription will automatically expire upon the end of the thirty (30) day subscription cycle. 2.2.  The following are the offerings available to you through our Packages:

Disney+ bundle and Disney+ Add on

 

STAND-ALONE OFFERING

2.3.  This offering is available to you if you are a current or new Digicel + subscriber and you wish to add Disney+ to your [Digicel + Broadband only or Digicel + Bundle service]. You will be charged an additional fee for Disney+. Once you have paid for the Disney+ service, you will get immediate access to it.

 

2.4.  If you purchase this offering, you may cancel your Disney+ subscription at any time after thirty (30) days of activation. If you cancel your Disney+ subscription to this offering, you will still be a [Digicel + Broadband only or Digicel + Bundle service] subscriber.

 

BUNDLED OFFERINGS

2.5.  Our Disney+ bundle offering is available to you if you are a current or new Digicel + subscriber, and you have subscribed to the [qualifying Digicel+ Broadband only or qualifying Digicel+ Bundle service] Packages. You will be charged an additional fee for Disney+. Once you have paid for your Package, you will get immediate access to Disney+.

2.6.  If you have purchased a Disney+ bundle Package, you have agreed to add the Disney+ service as a part of your existing Digicel + subscription.

2.7.  If you purchase this offering, you may cancel your Disney+ subscription at any time after thirty (30) days of activation. If you cancel your Disney+ subscription to this offering, you will still be a [qualifying Digicel+ Broadband only or qualifying Digicel+ Bundle service] Package subscriber.

2.8.  Our Disney+ offering is available to you if you are a current or new Digicel + subscriber, and you have subscribed to the [qualifying Core Bundle] Packages. You will not be charged an additional fee for Disney+ because it forms a part of your Package. Once you have paid for your Package, you will get immediate access to Disney+ as a part of your Package.

2.9.  If you have purchased a Fiber 400, Fiber 600, Variety 400, Premiere 400 and Premiere+ 600 Package, you have agreed to add the Disney+ service as a part of your existing Digicel + subscription.

2.10.               If you purchase this offering, you cannot cancel your Disney+ subscription only, as it forms a part of your Package. Please refer to our Digicel + Terms and Conditions on how to cancel your Digicel + packages.

 

 

Additional Terms and Conditions

A.    For customer support, or to report a problem or send us your feedback, please contact us via 5999-8403333.

 

B.    This offering is offered for your personal use and not for commercial use.

 

C.    You are solely responsible for all associated fees and costs incurred by you for equipment, connectivity and data usage in relation to your Disney+ package offering subscription, and your access to and viewing of Disney+, including any roaming charges.

 

D.    We reserve the right to terminate this offer if, in our sole opinion, it is being abused, whether on a commercial basis or otherwise deemed as an attempt to undermine the integrity of our services.

 

E.    We reserve the right to modify, extend or discontinue (permanently or temporarily), this offering at our discretion.

 

F.    We reserve the right to, at any time, with or without notice, vary or cancel these terms and conditions. In the event of us giving notice to you of any such changes to or cancellation of the offering, it shall suffice for us to give you notice via email or to post such notification on the Digicel website or the My Digicel mobile application. Any such notification shall be effective immediately or as of the date referred to in such notifications.

 

G.   You accept that certain content or features of Disney+ may not be available in your country or in your preferred language. Please note that channels or content available in your current location may become unavailable to you if you travel to another location in which such channels or content are restricted.

 

H.    The terms and conditions which apply to you are those published on the Digicel website at the time that your subscription is most recently renewed.
