“DIGICEL CHRISTMAS IS D’BESS – CHANCE TO WIN” PROMOTION TERMS AND CONDITIONS

The following are the terms and conditions governing this Promotion:-

1. What is the “Digicel Christmas is D’Bess– Chance to Win” Promotion about?

Digicel is offering its mobile customers (both Prepaid and Postpaid) and Digicel+ customers (“Customers”) a chance to win weekly prizes and 1 of 2 grand prizes, subject to these terms and conditions, during the period from 12:00a.m. on 1^st November, 2023 to 11:59p.m. on 31^st December, 2023 (“Promotional Period”).

2. How can customers enter this Promotion?

The following are the methods by which Customers can enter this Promotion during the Promotional Period:

• As a Digicel Prepaid mobile customer: Purchase any My plan
• As a Digicel Postpaid mobile customer: Sign up for any Postpaid My plan or Pay bill in full and on time
• As a Digicel+ customer: Sign up for any Digicel+ service or Pay bill in full and on time
• Switch network: Port over to our mobile network or Digicel+

3. Are there any other methods of entry?

Yes, customers can dial *323# or use the My Digicel App to purchase chance to win entries.

4. Are there any additional offers?

Persons who switch networks over to Digicel mobile or Digicel + will also receive a FREE refill of LPG cooking gas.

5. What are the conditions surrounding receiving the LPG cooking gas refill?

• In addition to this Promotion, the following customers can be entitled to win a FREE 20lb LPG/Cooking Gas Refill or a discount of $20.00TT on a 100lb Gas Refill:-
• customers who switch to Digicel’s mobile service (prepaid or postpaid) during the Promotional Period;
• Existing Prepaid mobile customers who switch to Postpaid during the Promotional Period;  or
• New Digicel+ customers who are installed within the Promotional Period;
• Delivery of a 20pound LPG Cylinder Refill or 100pound LPG Cylinder Refill (“Refill”) by Ramco to specified Digicel Customers shall be done on an agreed date with the Customer during the period from November 1st, 2023, to January 31st, 2024.
• Upon delivery on the agreed date, if the Customer is not available to receive the Refill, the Refill will be returned to Ramco and will be made available to the Customer for pick up at Ramco’s North (Lot #2 Old Piarco, Maloney) or South Office (#2 Shafik Drive, Cross Crossing, San Fernando).
• Arrangements can be made between the customer and Ramco. Customers can contact Ramco Toll-Free on 800-4LPG (4574), 800-COOK (2665), or email Ramco at ramco@rahamutgroup.com.

6. What are the grand prizes to be won and the draw dates for the promotion?

The table below outlines the prizes and draw dates for each prize during the promotional period

7. Are there any specific conditions attached to receiving the Home Makeover Grand Prize?          

• Yes, as the winner of the Home Makeover Prize:
• The winner must select furniture and/or appliances from a Courts store within Trinidad and Tobago of his/her choice and submit the related invoice/s to Digicel within three (3) months from the date they were contacted by Digicel notifying that they were the winner.
• Any charges beyond the value of TT $30,000.00 for selected furniture and/or appliances will not be covered by Digicel and shall be the winner’s responsibility.

8. Are there any specific conditions attached to receiving the Kitchen Makeover Grand Prize?

• Yes, as the winner of the Kitchen Makeover Grand Prize:
• The winner must select furniture and/or appliances from a Courts store within Trinidad and Tobago of his/her choice and submit the related invoice/s to Digicel within three (3) months from the date they were contacted by Digicel notifying that they were the winner.
• Any charges beyond the value of TT $30,000.00 for selected furniture and/or appliances will not be covered by Digicel and shall be the winner’s responsibility.

9. What are the weekly prizes to be won and the draw dates for the Promotion?               

The table below outlines the prizes and draw dates for each prize during the Promotional Period

NB:  Once a customer has not won a weekly prize, their entries will be included in any other subsequent weekly draws.

10. How will winners be notified?

After a winner is randomly chosen for each of the weekly prizes or a grand prize, Digicel will place a call to that customer’s number. Digicel will make only one (1) attempt to call the selected number. If no one answers that call, another winner will be randomly selected.

A winner shall be deemed the person identified (by the person answering the call) as the owner of the Digicel account.

The winner will also be announced on Digicel’s Facebook and Instagram page.

11. How many times can a Customer enter for a weekly draw?

• There is no limit to the number of times a Customer can enter for a weekly draw.
• Once they have not won a weekly prize, their entries will be included in any other subsequent weekly draws for this Promotion.

12. How many times can customers enter during the Promotional Period for the chance to win a grand prize?

• There is no limit to the number of times a customer can enter during the Promotional Period for a chance to win a grand prize.
• Once they have not won a grand prize, their entries will be included in any other subsequent grand prize draw for this Promotion.

13. Can a weekly winner choose which prize they will receive?            

Yes. A Customer can now choose the weekly prize they would like as their chance to win. Once the Customer wins a weekly prize, they will be awarded the prize they chose.     

14. Will Customers be able to win a weekly prize for each of the weekly draw dates?

No. If a Customer wins a weekly prize, he/she will not be eligible to win another weekly prize during the Promotional Period, however, they will still qualify for a chance to win a grand prize.

15. Will a Customer be able to win another grand prize if I have already won a grand prize in this Promotion?                 

No, Customers will not be eligible to win another grand prize once they have already won a grand prize.

16. Can a Customer who did not win a weekly prize be eligible for the grand prize draw?

All entries during the Promotional Period will be valid for a grand prize draw. 

17. Can a Customer win a weekly prize and a grand prize?

Yes, the weekly prize winner is still eligible to win a grand prize. A weekly prize winner, however, would not be eligible to win another weekly prize.

18. Where can a winner collect his/her prize?

• A winner can collect his/her prize at Digicel’s head office located at 11C ANSA Centre, Maraval Road, Port-of-Spain.

19. Conditions of Use

• This Promotion is open to Digicel+ customers and all Digicel mobile postpaid and prepaid customers except when roaming and except Corporate customers (and those who are not eligible as they fall into one of the categories identified in the terms below.)

To enter and be eligible to win:

• You must be a legal resident of the Republic of Trinidad and Tobago
• You must be 18 years of age or older
• If you are a Digicel postpaid mobile subscriber, your account must be in good standing or if you are a Digicel+ customer, your account must be in good standing

The following terms apply to All Digicel Customers

• Digicel will not notify participants of the number of entries obtained for this Promotion.
• Persons in any of the following categories are NOT eligible to participate or win any of the prizes:
• Any person who at any time on or after 1^st November 2023 was or is a director, officer, employee, agent of Digicel (Trinidad & Tobago) Limited or any of their respective parent, subsidiary, or other affiliated companies, franchisees or service agencies or independent contractors
• Individuals engaged in the development, production, advertising or distribution of materials for this Promotion (collectively the” Promotional Entities”); and
• Persons who are or purport to be immediate family members (defined as biological parent, step-mother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories (i.e. who have lived in the same household for at least three (3) of the twelve (12) months preceding 7th November, 2022 whether those persons are related or not).

Conditions of Entry

• Participants acknowledge that compliance with these terms and conditions including all eligibility requirements is a necessary pre-condition to any of the prizes being awarded to them. For removal of all doubt, participants who have not complied with these terms and conditions are subject to disqualification.
• The winner may be required to provide Digicel with proof that he/she is the authorized account holder/owner of the Digicel account associated with the selected winning entry before the prize is given to him/her.
• Winners shall be fully responsible for the payment of all taxes, duties or statutory deductions in relation to the prizes awarded for this Promotion.
• Digicel reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Digicel corrupt the administration, security, integrity, or proper conduct of this Promotion.
• Digicel does not warrant that access to or use of the Digicel service will be uninterrupted or free of any of the events stated below, due to the nature of computer and wireless communications. Digicel and the Promotional Entities are not responsible for any problems that may arise, including but not limited to:
• lost, interrupted, inaccessible or unavailable networks or other connection, availability or accessibility problems arising in connection with or over the course of this Promotion;
• communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties;
• failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prizes or in the prize notification documents;
• for any errors of any kind in connection with this Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or
• the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion.
• Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and/or civil laws in the countries where this Promotion is being run. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.
• In no event will Digicel be liable for more than the relevant prize available under these terms and conditions.
• Prizes may not be transferred or exchanged for another product or for cash.
• In the event of any conflict with any promotional details contained in these terms and conditions and promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media, (“Promotional Materials”), the details of this Promotion set forth in these terms and conditions shall prevail.
• The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these terms and conditions in any manner whatsoever.
• All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel. By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel, its agencies or its affiliates, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim a prize. 
• Digicel reserves the right to award any forfeited prizes to another participant in the Promotion.
• Warranty and support information relating to prizes will be included in product packaging. All the prizes awarded during this Promotion are subject to the manufacturer’s warranty and Digicel makes no representation as to the functionality of any of the prizes.
• Save in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage.
