The “Competition” (the “Promotion”) Frequently asked Questions (“FAQ”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for chances to win certain prizes in the win competition. You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Newcom, a company registered at 14 Ocean Boulevard, Kingston. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “You” means the person accessing or using the text to participate in the Promotion (and “my” and “your” shall have the same meaning).

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.

1. What is the “Digicel’s Christmas Magic Spin to Win Competition”?

The “Digicel’s Christmas Magic Spin to Win Competition” gives Digicel customers a chance to win great prizes by registering and participating in the competition.

2. What is the promotional period for the Promotion?

The promotion is valid from Friday, December 1^st, 2023, 12:00AM through to Wednesday, January 31^st, 2024, 11:59pm.

3. Who is eligible to enter the Promotion (the “Eligible Customers”)?

In order to be eligible for the Promotion, you must be a Digicel customer with an active Digicel prepaid and/or postpaid account.

The following customers are excluded from participating in the Promotion:

1. Postpaid Corporate & Business account customers;
2. Digicel and Newcom employees, dealer principals or employees of any of our affiliated companies, advertising, competition and public relations agencies, dealers, distributors and their immediate family members are not eligible for entry. For these purposes immediate family members are spouses, parents, siblings and children.

4. Which Digicel prepaid/postpaid bundles/plans are included in the Promotion?

For this competition, customers will be unable to purchase tokens from their data/voice or text bundles.

5. How does a customer participate in the Promotion?

• You may enter by texting the word PLAY to 8764442424.
• Upon texting the word PLAY you will be registered in the Digicel’s Christmas Magic Spin to Win Competition. There is a $15 charge to register for the competition. You will then receive a text message advising of the type of token, the number of points assigned and your rank in the competition.
• Once the keyword ‘PLAY is sent, customers will receive another message advising them that by registering they will receive one of the six (6) tokens each day at 10 am with the value of that token and their rank providing the subscriber has enough credit to cover the $15 charge daily.

  • Customers can request additional tokens to increase their chances in the game. Customers can text XMAS to 876-444-2425 to request additional tokens to increase their chances of winning prompted by text to enter for more chances to win.

Customers will be charged $15 for each token sent (the customer is charged when the token is received).

• Customers can also log on to MyDigicel app and select the menu option then click on the Digicel’s Christmas Magic Spin to Win tab to play the competition.

1. The customer will have the option of purchasing multiple spins at once.

1. Once the required number of spins is selected, the player will be advised of the total charge. $15 per spin)

Eg To spin, it will cost JMD15 credit. (Player has the option to continue or cancel). If players choose to continue, the wheel will spin and land on a token. Player will now be advised of the total points received for the spin as well as rank and total accumulated points.

• Customer can also go to the GameNation portal (https://www.playgamenation.com) to spin the wheel. This portal functions similar to MyDigicel App. The customer will be required to create a Digicel account or if already created, to login to the portal. Customer will then be able to select the Digicel SPIN to Win Competition to play.

6. Will customers be notified when to participate in Promotion?

Upon the commencement of the promotion, customers may receive the following:

• SMS push; and
• Digicel’s Balance Enquiry message

7. How many times can a customer win?

Customer can win only once for the weekly prizes but will be eligible to win December’s prize as well as the overall prizes. Three (3) grand prizes, 4 randomly selected prizes, two (2) December prizes, as well as 8 weekly prizes will be awarded for the duration of the promotion. There will also be 2 GameNation prizes that will be awarded to 2 random persons who play on the GameNation platform. The breakdown of the winners and prizes are set out below:

8. What tokens are sent at each request and what number of points are assigned to each?

Tokens and their corresponding points are shown in the table below:

Randomly selected tokens are sent to each participant’s phone. You will receive a token along with points and your rank per request. By texting “XMAS” to 876-444-2425 you will be able to collect more tokens to increase your points and rank in the competition. Note: Each text received from 876-444-2425 will be at the cost of $15.

9. Can I increase my points and rank in the competition?

• As well as by spinning the wheel on the MyDigicel App or GameNation portal, you will be able to get more tokens to increase your points and rank in the competition. Each SPIN will be at the cost of $15. Upon spinning the wheel, you will receive a message similar to the following:

You have been charged $15 for 1 entry at $15 per entry.

10. What is a ‘Bonus’ day?

The competition will have the element of double, 5Up days, 10Up, 50Up, 100Up, 200Up, 250Up, 300Up and 500Up days. On the Double day, participating subscribers will receive double the amount of points for the tokens received hence giving an increased chance to WIN. On the 5up day, Digicel will give 5 times the number of points for every token received on that day etc.

• Digicel selects a random day in which each token assigned points are doubled etc. for that day. Customers will receive a text similar to the one below:

11. How are the prizes distributed?
    • There will be three (3) overall grand prize winners and 2 randomly selected winners, four (4) December prize winners, 8 weekly prizes as well as 2 GameNation prizes in the draws for the Digicel’s Christmas Magic Spin to Win Competition who will be awarded as per prize table at #7.
    • The overall top ranked player will be selected as the first prize winner, the overall second top ranked player will be selected as the second prize winner and overall third top ranked player will be selected as the third prize winner for the duration of the competition. The December top ranked player will be selected as the first prize winner, the December second top ranked player will be selected as the second prize winner for the December prizes. The weekly winners, the GameNation prize winners, as well as the random prize winners will be selected randomly.
    • Potential winners must be able to correctly state the name of the current promotion “Digicel’s Christmas Magic Spin to Win” Competition” in order to qualify for the prizes.
    • A maximum of three (3) calls will be made to the selected winners within the period of an hour. If no response is received during that hour, another winner will be selected from the backup list of 19 potential winners in order of rank with the highest points accumulated or from randomly selected list as in the random prizes.
    • If the customer selected with the highest score (top ranked) does not correctly state the name of the promotion, the customer with the next highest score or tied score will be selected and called until a winner is chosen from the backup list.
    • If there is more than one customer tying for the highest score, a winner will be randomly chosen from these customers, and the other will be awarded the second (2nd) prize. Same process will apply for other prizes where applicable.

Draw Dates

• In addition to these Terms and Conditions, the Customer remains bound by any other terms and conditions of use of any of Digicel’s other services including the general Terms and Conditions governing Digicel’s Data Services and Digicel Telephone Services.
• In the event the account of a Customer who is eligible to win any of the prizes is the subject of a billing dispute in relation to the Competition as a result of fraud, erroneous charging, other technical problem that corrupts the administration, Digicel with the approval of Betting, Gaming & Lotteries Commission reserve the right to withhold the prize, terminate, cancel, suspend and/or modify the Competition until the disputed amount (and related charges) have been investigated.

12. Is there a cut off time for entries to be received?

Yes. All entries for the prizes must be received by 11:59:59pm on Wednesday January 31^st, 2024.

13. When will the grand prize winners be selected?

Three Grand Prizes will be awarded on Thursday February 1, 2024, to the top three (3) ranked players and 2 randomly selected winners for the promotional period. Kindly refer to draw table above for the breakdown in how prizes will be awarded.

14. If I was contacted and won, where do I collect the prize?

Winners will receive a direct transfer to their accounts. Winners will be asked to provide banking details to facilitate the direct transfer. For the tangible prizes (i.e., appliances and phones), winners will be asked to visit head office (14 Ocean Blvd), Mandeville office (Juci plaza) or Montego Bay office (Fairview Office Park) based on their location.  A valid government issued id (passport, Driver’s license or national id) is required in order to claim their prizes. Winners will not have the cheque option for now until further notice is given.

• Minors (under 18) winning must provide details (birth certificate etc.) for parents/guardians in order to claim prizes. Parents/guardians should present (via email) a valid national government ID as well as they should present the child’s ID. In the case, the child does not have a valid national government ID then a birth certificate or student ID will be acceptable via email.

15. If I was contacted and have won, how long do I have to collect my prize?

Cash prize winners have a maximum of fourteen (14) business days to provide banking details and government issued id (passport, Driver’s licence or voter’s id) after they have been notified a winner. Tangible prize winners have a maximum of fourteen (14) business days to pick up prizes after they have been notified a winner. Winner will be required to provide a valid government issued id (passport, Driver’s licence or voter’s id to claim prize. Digicel will retain any prize not issued within the stipulated period.

16. Is this game authorized by Betting Gaming and Lottery Commission?

Yes, this game is “Authorized under Section 58(3) of the Betting, Gaming and Lotteries Act.”

Additional Terms and Conditions

1. This Promotion is offered for your personal use and not for commercial use and you agree not to sell any rewards redeemed through this Promotion.
2. Digicel gives no warranty or guarantee that its network or services shall be continuous, or will be free from faults. Digicel will, however, use its best endeavours to ensure its network and services are reasonably fault free, and that service is reasonably uninterrupted.

1. We reserve the right to disqualify you or terminate this offer with prior approval from Betting Gaming & Lotteries Commission if the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes (where applicable), whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

1. You are solely responsible for all associated fees and costs incurred by you for redemption of prizes and for connectivity in relation to your use of the text messages. Be reminded that once roaming, you will not be able to use any data from your local prepaid or select postpaid plans.

1. The selected winners must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes.

1. We reserve the right to modify or discontinue (permanently or temporarily), this Promotion being offered to you upon approval of the Betting Gaming and Lotteries Commission (BGLC)

1. Prizes (if other than cash prizes) are not exchangeable and are not redeemable for cash.

1. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion subject to the BGLC approval. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications upon the approval of the BGLC

Any personal data relating to participants will be used solely for the purposes of this promotion by Digicel and/or by any agent appointed by it to assist with running the promotion on behalf of Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the promotion for the purposes of administration of the promotion (including publishing your full name and country and/or disclosing it to third parties on request if you are the winner) and any other purposes to which you have consented. 2. Winners may be required to take part in related publicity, including (without limitation) publication of the name and image of a promotion winner along with their winning entry via Digicel’s website, social media and other press and media channels. No additional payment will be given for this. The winners will be asked to sign a form to agree to this. Refusal to participate will result in forfeiture of the prize.
