The “DIGICEL’S SCRATCH AND WIN” (the “Promotion”) Frequently asked Questions (“FAQ”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for chances to win certain prizes in the scratch and win competition. You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Digicel, a company registered at 14 Ocean Boulevard, Kingston. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “You” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.

1. What is the “DIGICEL’S SCRATCH AND WIN” Promotion?

Scratch and Win is a game where the player can virtually scratch away the surface of an image. The image itself will show whether you won or lost. If you win, you get a visual of the prize you won, if you lose you get a "lost" visual.

2. Who is eligible to enter this promotion?

• All Digicel customers 16 years and older, including postpaid, prepaid and dual customers are qualified to participate in the promotion.
• Digicel employees, dealer principals or employees of any of our affiliated companies, advertising, competition and public relations agencies, dealers, distributors and their immediate family members are not eligible for entry. For these purposes immediate family members are spouses, parents, siblings and children.

3. What is the promotional period?

• The promotion begins at 12am on Thursday, February 1^st, 2024, to 11:59:59 Sunday, March 31^st, 2024.

4. How does the promotion work?

• To enter the competition the customer must access the URL link (https://www.playgamenation.com/) provided to them in a text.
• This promotion is valid for Digicel customers only.
• Once a customer clicks on the link received in the message, the customer will be directed to a page where they will be required to create a Digicel Account. If the subscriber chooses to continue, he/she will be able to register for the service thus accepting the terms and conditions of the promotion.

5. Can I access the App free?

• No, data charges will apply.

6. What is the cost to play DIGICEL’S SCRATCH AND WIN?

• You will be required to have $20 available credit to be able to participate in the game.

7. How are winners selected?

• There will be a random selection of the winners and their prizes.
• Winners of cash prizes will be notified via a call each week.
• Call credit will be sent to each winner’s phone the day after winning.
• The Winner of cash prizes will have fourteen (14) days within which to claim their prizes after notification. If unclaimed, Digicel will retain prize for other promotional activities.
• As we have suspended the issuing of cheques, cash prizes will be awarded via bank transfer. Winners will be required to provide banking details within 14 days of notification in order to receive their prizes.
• Winners must provide a valid government issued ID that is passport, voter’s id or driver’s license as well as full banking details via email in order to redeem the Prize.
• Players may win as many times as the prizes are available.

8. How will I know if I have won?

If you win, you get a visual of the prize you won, if you lose you get a "lost" visual.

9. What if I was contacted, but I missed the call?

• Three (3) calls will be made to the selected winner of cash prizes within a period of an hour. If the phone is engaged, not answered, switched off or goes to voice mail, this is considered a failed attempt.

10. If I was contacted and have won, how long do I have to collect my cash prize?

• You are required to claim your prize within 14 days of being contacted.

11. What do I need in order to claim prizes?

• Cash prize winners are required to provide the below information:
  • Banking account details (Name on Account, Account Number, Type of Account and Name of Bank and Branch.
  • A valid government ID that is passport, voter’s id or driver’s license.

12. Am I allowed to enter if I am under 18 years of age?

• Persons under 18 years are allowed to enter however, minors should be at least 16 years old to participate.

13. What do I do if I have won and I am under 18 years old?

• Juvenile (16 years and older) winners must provide banking details for their parents/guardians in order to claim prizes. Parents/guardians should present a valid national government ID as well as the child by email. In the case the child does not have a valid national government ID then a birth certificate or passport will be acceptable.

14. Is this game authorized by Betting Gaming and Lotteries Commission?

• Yes, this game is “Authorized under Section 58(3) of the Betting, Gaming and Lotteries Act.”

TERMS AND CONDITIONS

1. This Promotion is offered for your personal use and not for commercial use and you agree not to sell any rewards redeemed through this Promotion.
2. Digicel gives no warranty or guarantee that its network or services shall be continuous, or will be free from faults. Digicel will, however, use its best endeavours to ensure its network and services are reasonably fault free, and that service is reasonably uninterrupted.

We reserve the right to disqualify you or terminate this offer with prior approval from Betting Gaming & Lotteries Commission if the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

1. You are solely responsible for all associated fees and costs incurred by you for redemption of Prizes and data or other charges associated with internet connectivity. Be reminded that once roaming, you will not be able to use any data from your local prepaid or select postpaid plans.

1. The selected winners must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes.

1. We reserve the right to modify or discontinue (permanently or temporarily), this Promotion being offered to you upon approval of the Betting Gaming and Lotteries Commission (BGLC)

1. If a prize is unavailable, we may, substitute the prize with an alternative prize to the equal value and/or specification upon the approval of the BGLC.

1. Prizes (if other than cash prizes) are not exchangeable and are not redeemable for cash.

1. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion subject to the BGLC approval. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications upon the approval of the BGLC

Any personal data relating to participants will be used solely for the purposes of this promotion by Digicel and/or by any agent appointed by it to assist with running the promotion on behalf of the Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the promotion for the purposes of administration of the promotion (including publishing your full name and county and/or disclosing it to agents on request if you are the winner) and any other purposes to which you have consented. Winners will be required to participate in any planned publicity in connection with this competition.  By entering the Competition, the prize winner consents to the use of his name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by us or our agencies, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim the prize.

Winners may be required to take part in related publicity, including (without limitation) publication of the name and image of a promotion winner along with their winning entry via Digicel’s website, social media and other press and media channels. No additional payment will be given for this. Refusal to participate will result in forfeiture of the prize.
